Terms and Conditions  for Katherine's Closet


These terms and conditions were last updated May 25, 2008 

Use of our website and the sale and purchase of goods from the website are governed by our terms and conditions as set out below. "We" or "Our" means Katherine's Closet. "You" or "your means the person accessing using or ordering from our website or over the INTERNET. 

Prices, Descriptions and Availability of Goods

Prices are subject to change without notice and all goods are sold subject to availability. Where goods are temporarily out of stock we will contact you so that you may choose between a refund on the item, having it shipped when it is back in stock or select an alternate product. Whilst we take the utmost care to ensure the product description,, pictures, information and prices are accurate we do not accept liability for any inaccuracies, errors, or omissions. Colours may vary slightly from those shown on the website due to the limitations of internet technology. Orders are accepted at our sole discretion and we maintain the right to decline orders without giving an explanation. 

SALES TAX 

Value Added Tax (VAT) is calculated on shipping destination, with the exception of children's clothing where this does not apply. When applicable it is included in the price for orders shipped to destinations within the European Union (EU). For orders shipped to destinations outside the EU the price excludes VAT but orders may be subject to local tax or import duty.  These are not included in our prices and customers remain liable for payment of these taxes or duties on or following delivery. 

HOW TO ORDER 

Orders shall be acepted at our sole discretion but will normally be accepted if the goods that you order are available and your credit card is authorised for the transaction. We will contact you if there are any problems with these issues.  You will receive an automated e-mail with the status of your transaction. 

Prices quoted to you are the prices set at the time. If for any reason they are increased we will let you know by e-mail and inform you prior to processing your order. 

Your order will be accepted by us when we send you payment notification by us and we will include a copy of your invoice with your order.

 Shop by browsing through our website.  Click on the collection to see the full range or go to our Designers Page, if you wish to view by Designer. 
Click on the relevant image to access the individual item's product page, You can then choose the size, colour and quantiy you want. If you are unsure on size you can click on the size charts to give you the exact  measurements. Please note all designers do not provide us with their size charts. Add Merchandise to your shopping cart by clicking on the "add to cart" near the desired item. 

Review the items in your shopping cart, you can remove, delete or update your shopping cart by clicking on either "remove" "delete" or "update" to the left hand side of the page "view cart".   To continue shopping, click on the large button at the bottome of the page. Please  be aware that items put in your cart can still be purchased by another customer.  Proceed to the checkout by clicking on the checkout button and choose your method of shipping.

Payment Methods 

We accept  Pay Pal, World Pay, Visa, Mastercard, Switch Delta, Electron, Solo, American Express. All prices are in in pounds sterling (£) and credit/debit card transactions for orders outside the UK will be converted by the card company at their current exchange rate. 

DELIVERY METHODS 

Your shopping cart displays the goods you have purchased with an indicaation of the delivery timescale. We will notify you when your order has been dispatched. The costs for your delivery are shown depending on the shipping destination and the delivery service selected. Any delivery times are quoted on estimates and are based on availability and normal delivery time. 

FAILED DELIVERY 

We will deliver the goods to the address for delivery that you specified when you placed your order. Please be accurate when you give us your address as we will not be liable if the address that you have given and that we will deliver to is incorrect. 

OWNERSHIP

You will own the goods once they have been delivered to the address specified and when we have received cleared payment notification for the goods in full. Until that time then we will retain title to the goods. 

COOLING OFF PERIOD AND CANCELLATIONS/RETURNS 

We want you to be satisfied everytime you shop with us. If for any reason you are unhappy with the goods purchased you may cancel your order and return the goods to Katherine's Closet within  7 working days from receipt of the goods, you will receive a refund within 30 days of cancellation.  It is your responsibility to take care of the goods before returning  them.  They must be returned with the sales tags intact and in a state that they can be resold. We will not accept returns of goods that have been altered.

When returning goods, please enclose a covering letter with the return detailing your name, full address, order number and reason for the return(please specifiy whether you require an exchange or a refund) We recommend that you use Recorded Delivery, as proof of shipping is not proof of receipt. 

Unless the goods are defective, damaged or not as specified on your order acknowledgement, you are responsible for the the cost of returning the goods to the merchant. If however the goods are faulty then the postage costs will be refunded.

Gift Returns

If you have received an item from Katherine's Closet you may return it as an exchange only.

Your Statutory rights are not affected by our returns policy.

We will take all reasonalbe care to keep your order secure, but in the absence of our sole negligence we cannot be held liable for any loss you may suffer if a third partry obtains unauthorised access to any of your data, including credit card details. that you have provided.

We shall not be liable to you in connection with this agreement in contract, tort (including negligence) or otherwise for any loss of profit, anticipated savings or data (in each case whether direct or indirect) or any indirect loss. 

VARIATION OF TERMS AND CONDITIONS

We reserve the right to change,modify, sustitue or remove with notice any information on the website from time to time. 

GOVERNING LAW 

These terms and conditions shall be governed by and construed in accordance with Scottish law. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts, to which both parties submit.
